2. INFORMATION ON PROCESSING

The General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, (“GDPR”) and Law No. 58/2019 of August 8 ensure the protection of natural persons with regard to the processing of personal data and the free movement of such data.

In legal terms, personal data is considered to be any “information relating to an identified or identifiable natural person (“the data subject”); an identifiable person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, electronic identifiers, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person”.

The personal data provided by the user will be included in a file under the responsibility of SPREADHUNTERS, whose processing will be carried out in accordance with the legislation on the protection of personal data, being applied the appropriate technical and organizational security measures.

SPREADHUNTERS maintains a database with the registration of its customers, composed only of personal data provided by the data subject, which are collected and processed automatically by SPREADHUNTERS, the entity responsible for the processing of personal data.

In no case will personal data on racial or ethnic origin, political opinions, religious or philosophical beliefs, political opinions, trade union membership, data relating to health and sex life, genetic data, biometric data or data relating to sex life or sexual orientation be requested.

In no case will SPREADHUNTERS perform any of the following activities with the personal data provided through this site, without the express prior consent of the data subject:

  • Give it to other persons or other entities;
  • Transfer outside the European Economic Area (EEA).

3. PURPOSES OF PERSONAL DATA PROCESSING

The personal data processed through this page will only be used for the following purposes:

  • To allow SPREADHUNTERS to act as a credit intermediary, in order to collect data for a credit proposal with a credit institution;
    Identify the most appropriate services to the specific case of the user, upon request;
  • Statistical analysis activities;
  • Marketing, if the client has given his consent. (The sending of promotional communications or marketing activities on products of SPREADHUNTERS or partners that are of interest to the user, will be directed only to users who have previously expressly authorized).
  • SPREADHUNTERS guarantees the confidentiality of all data provided.

Nevertheless SPREADHUNTERS proceed to collect and process data in a secure manner and to prevent their loss or manipulation, using the most appropriate techniques for this purpose.

Failure to respond to data marked as mandatory, implies the impossibility of responding to the request of the data subject.

The legal grounds for processing personal data for the aforementioned purposes, as the case may be, are consent of the data subject is a party, performance of a contract to which the data subject is a party, compliance with a legal obligation or the legitimate interest of the controller.

The data are kept for as long as necessary for the purposes for which they were collected, for compliance with legal retention periods and until any responsibilities of the controller are extinguished.

4. SECURITY MEASURES

SPREADHUNTERS has implemented and will continue to implement the technical and organizational security measures necessary to ensure the security of personal data provided to it in order to prevent their alteration, loss, processing and/or unauthorized access, taking into account the current state of technology, the nature of the data stored and the risks to which they are exposed.

Whenever accessing personal data SPREADHUNTERS, undertakes to:

  • Store them by means of legally required security measures, of a technical and organizational nature, which guarantee their security, thus avoiding alteration, loss, treatment or unauthorized access, in accordance with the state of technology at each moment, the nature of the data and the possible risks to which they are exposed;
  • Use the data exclusively for the purposes previously defined;
  • Ensure that the data is handled only by those employees whose intervention is necessary to meet the request of the data subject, who are bound by the duty of secrecy and confidentiality. If it is possible that information may be passed on to third parties for these purposes, they are required to maintain the necessary confidentiality.
